§ 1 General Provisions

(1) The following Terms and Conditions apply to all contracts concluded between you and us, the provider (Thalib Khreis), through the website www.trySmile.de. Unless otherwise agreed, the inclusion of any of your own terms and conditions is hereby rejected.
§ 2 Conclusion of the Contract The subject matter of the contract is the sale of goods. By listing the respective product on our website, we make you a binding offer to conclude a contract through the online shopping cart system under the conditions specified in the product description. The contract is concluded through the online shopping cart system by placing the goods in the shopping cart, then entering your details via “Checkout” and reviewing the order summary displayed to you. By submitting the order, you make a legally binding offer, which is accepted by our confirmation. Requests for the preparation of an offer are non-binding. Any offer made by us will be provided in text form and may be accepted within 5 days. The process is handled by email, so you must ensure that the email address provided is correct.
§ 3 Special Provisions Regarding Payment Methods Payment processing is carried out, depending on your selection, via SOFORT, Klarna, SEPA Direct Debit, PayPal, or Stripe. With SOFORT, the amount is charged immediately through an online banking system operated by the Klarna Group. With Klarna, payment is made to Klarna and may be subject to a credit check. With SEPA Direct Debit, you grant a mandate to collect the amount; chargeback costs shall be borne by you if you are responsible for them. With PayPal, payment is processed through PayPal (Europe) S.à.r.l. et Cie, S.C.A. With Stripe, payment is processed through Stripe Payments Europe Limited.

§ 4 Right of Retention, Retention of Title A right of retention exists only for claims arising from the same contractual relationship. The goods remain our property until full payment has been received.

§ 5 Warranty The statutory warranty rights for defects apply. Consumers are requested to inspect the goods upon delivery and report any defects. Deviations shall only be deemed agreed if they were expressly specified before conclusion of the contract.

§ 6 Choice of Law German law applies, taking into account the consumer protection laws of the consumer’s country of residence. The UN Convention on Contracts for the International Sale of Goods is excluded.
§ 7 Protection of Minors

§ 7 Protection of Minors Sales are made only to persons who have reached the legally required minimum age. By placing an order, this is confirmed. Age verification may be carried out by the delivery service.

In the event of a chargeback caused by you, you shall bear the resulting chargeback fees. When using PayPal, payment is processed through PayPal (Europe) S.à r.l. et Cie, S.C.A. When using Stripe, payment is processed through Stripe Payments Europe Limited.
